Hospital Team Leads Get Trial on Overtime Claims

On March 16, Barrett & Farahany, LLP attorneys Benjamin Stark and Severin Roberts successfully overcame a motion for summary judgement in Sanchez v. St. Joseph's/Candler Health Sys., Inc., 2018 BL 90861, S.D. Ga., No. CV 416-225. Stark and Roberts represented two former employees of a hospital who were not paid overtime. The hospital's attorneys moved for summary judgment, claiming the former employees were exempt from overtime pay. In their response, Stark and Roberts pointed to evidence of non-exempt duties and the lack of discretion the two employees were allowed to use in their jobs. The court ruled that the hospital failed to prove the women qualified as exempt executives or administrative employees under FLSA. Therefore, the court is rightly allowing the case to move forward to trial by jury.
