In a recent discrimination lawsuit, the former Deputy Chief of Staff for the Fulton County District Attorney’s Office, represented by Barrett & Farahany partner Matthew Billips and attorney Benjamin Stark, urged the Eleventh Circuit to revive her Title VII claims against the office. She cites that she was not a personal staff member of DA Paul Howard, therefore, the office should not have asserted Title VII’s exemption of personal staff of elected officials as a defense after the close of discovery in the case.
According to a recent Law360 publication, Stark said Younge would like to work again for the Fulton County District Attorney’s office, particularly under the current district attorney, Fani T. Willis. He said the Eleventh Circuit should recognize that it was “fundamentally unfair” for the case to end based on a defense not raised until months after discovery was completed.
Stark added, “We believe that this case is a strong candidate for reversal by the Eleventh Circuit. Both judges who reviewed the case at the district court recognized that there is strong evidence that the DA’s office discriminated against Dr. Younge based on her pregnancy — evidence that a jury should see.” Learn more.
