Barrett & Farahany is pleased to announce the resolution of a longstanding race discrimination case that resulted in a $4.535 million consent judgment in favor of client Kenny Faulk.

Mr. Faulk filed suit against Dimerco Express USA Corp. in 2021, alleging that the company rescinded a job offer for an account executive position after learning he was Black. According to court filings, Mr. Faulk alleged that the company sought to hire more white employees to attract white clients. Dimerco denied the allegations and maintained that its hiring decision was based on information uncovered during a background check.

Following a trial in 2023, a federal jury found in favor of Mr. Faulk and awarded $3 million in punitive damages, $300,000 for emotional distress, and $90,000 in lost wages. Dimerco subsequently challenged the verdict and sought a new trial. In July 2024, the court declined to overturn the jury’s decision, finding that the issues raised by the defense did not prejudice the outcome of the trial.

The litigation continued through the appellate process before ultimately concluding with a $4.535 million consent judgment approved by the U.S. District Court for the Northern District of Georgia on June 4, 2026.

Amanda Farahany of Barrett & Farahany represented Mr. Faulk throughout the litigation. Commenting on the resolution, Farahany told Law360 that a former Dimerco human resources representative had “passed the torch” to Mr. Faulk seven years ago to “fight against race discrimination.” She added that “Dimerco has been held accountable for its action.”
