AI

AI has become unavoidable for some and a fixture for others. It is very tempting when going through a difficult time to turn to an easy option to gather thoughts, facts, and opinions, but is it a mistake? Our Partner Jean Abreu discusses if using AI to organize your case before talking to a lawyer is a good idea or not. So we oftentimes when we’re speaking to potential clients, we’ll come across situations where the client will send us something that they’ve put into a chat bot to organize their thoughts before coming to speak to us.

And that can be very helpful for them sometimes. Sometimes it can be helpful in organizing information, but it is a major risk because some courts already have required parties to produce those exact exchanges they’ve had with AI.

They’ve held that there’s no confidentiality in regards to what a client puts into AI about their case, about the facts. And of course, an attorney is going to shape the facts in the way that is most valuable to you and most valuable to your case and is also going to think about how and when to divulge those facts or use that strategy.

So if a client has already put in all their information into AI and that we have to produce it, it can be really detrimental to their case.

Another, another thing that we see often is that clients will come to us after they have filed their own lawsuit using AI, and they are well into the lawsuit. AI has generated all of these documents that they’ve been filed with the court, but they come to us because their case is about to get dismissed because there’s some things that have gone wrong.

And at that point we can’t take the case because the case is isn’t such a risky procedural posture that there’s not much chance moving forward and those mistakes can’t be corrected. People are over relying on AI to their detrimental and then coming to us when it’s too late.
