Am I Entitled to Overtime?

The Fair Labor Standards Act entitles every employee to time and a half for hours worked over 40 in a workweek. All of us know this is true when dealing with an hourly pay structure, but did you know that you are also eligible if you are paid a salary?

Salaried employees are eligible for overtime compensation too!

Many employees aren't even aware that they are eligible for overtime pay. There are many requirements that must be met in order for an employee to NOT be eligible for overtime. Classification of employees incorrectly is one of the many ways that companies are illegally avoiding paying overtime to employees. Know your rights!

Almost 80% of workers are entitled to overtime,

yet over 70% of employers are not properly paying employees.

Employees are classified as either exempt or non-exempt. The difference between the two is their eligibility for overtime pay. A non-exempt employee is entitled to overtime — unless the employee meets very stringent requirements that categorize them as exempt. Many employers are categorizing employees as “exempt” to avoid paying overtime, when in actuality they are due overtime compensation.
