Nephron Overtime Lawsuit
Summary of Lawsuit
Nephron Pharmaceuticals employed Pharmaceutical Sales Representatives (“PSR’s”) and did not pay the PSR’s overtime for the hours worked over 40 in a workweek.
In February 2010, former employees of Nephron filed suit in federal court in Atlanta, Georgia accusing Nephron of failing to pay them the wages owed for overtime. The lawsuit accuses the company of uniformly and systematically violating the overtime provisions of the Fair Labor Standards Act by not paying overtime eligible employees 1.5 times their regular rate.
The case is at its early stages and the Court has made no finding that Nephron is liable. However, eligible employees may be owed thousands of dollars in overtime pay. The law allows employees to recover double their actual overtime damages if the court finds that an employer willfully violated the law. The Plaintiffs allege that Nephron willfully violated the FLSA and therefore seek recovery of double their unpaid overtime, as well as litigation costs, expenses and attorneys’ fees.
How do I join?
Current and former employees who worked for Nephron may be eligible to join this case and seek payment for overtime. If you are or were an employee of Nephron, you should fully read this notice and get involved.
The eligible position to participate is Pharmaceutical Sales Representatives.
In order for you to be eligible to assert a claim in this case, you must
(1) have worked as a Pharmaceutical Sales Representative;
(2) have worked more than 40 hours per week in the prior three years and not paid for those hours;
(3) execute a written consent form agreeing to join this case and be represented by Plaintiffs’ attorneys. Fill out the form fields below, and we will send the form to you to fill out and return.
