No one wants to find themselves in a legal battle, and most people never think that this will ever happen to them. However, anyone can encounter a challenging legal issue. While many typically think of the legal process as being costly and time-consuming, it doesn’t always have to be this way. It is possible to resolve your issue without the negative aspects of going to court. At Barrett & Farahany, we know the stress a legal issue can cause, and we want to help you avoid as much of it as possible.

Our mediation and arbitration services offer a better solution for many who need legal help. Reaching a resolution shouldn’t be any harder than it needs to be. Alternative dispute resolution (ADR) methods like mediation and arbitration could be what you need to settle your legal issue in a way that’s more beneficial. The attorneys of Barrett & Farahany can help.

How Do You Prove Age Discrimination in Georgia?

Mediation

Mediation involves in-formal, non-binding meetings with a neutral third party, the mediator. Depending on the situation, parties can meet together with the mediator or have separate meetings with the mediator. This gives parties the space to discuss their issues and reach a resolution without going to court.

During this process, the mediator is not responsible for making any final decisions for the parties involved. However, this isn’t always the end of the conflict. In some cases, mediation may be required before a case goes to court. While court may still be necessary, it may be an easier process, as the parties have already had the opportunity to discuss their concerns.

Arbitration

While it’s a form of alternative dispute resolution, arbitration works similarly to a regular court case. Arbitration occurs outside of court, is less formal, and gives each party the chance to tell their side of the story and provide evidence. Unlike in mediation, where the mediator does not make any final decisions, arbitrators determine the outcome of the arbitration process.

Today, many contracts include arbitration agreements that require issues to be settled through this ADR method rather than taking them to court.

Benefits of Alternative Dispute Resolution

ADR is preferable in many situations. Of course, this isn’t always an option, but when it is, it can be in your best interest. Some of the benefits of going through mediation or arbitration as opposed to going to court include:

  • Fewer expenses
  • Faster resolution
  • Maintained privacy
  • More control over the process
  • More flexibility
  • Reduced hostility
